Flawed clinical practice guidelines may compromise patient care. Commercial conflicts of interest on panels that write treatment guidelines are particularly problematic, because panelists may have conflicting agendas that influence guideline recommendations. Historically, there has been no legal remedy for conflicts of interest on guidelines panels. However, in May 2008, the Attorney General of Connecticut concluded a ground-breaking antitrust investigation into the development of Lyme disease treatment guidelines by one of the largest medical societies in the United States, the Infectious Diseases (...) Society of America (IDSA). Although the investigation found significant flaws in the IDSA guidelines development process, the subsequent review of the guidelines mandated by the settlement was compromised by a lack of impartiality at various stages of the IDSA review process. This article will examine the interplay between the recent calls for guidelines reform, the ethical canons of medicine, and due process considerations under antitrust laws as they apply to the formulation of the IDSA Lyme disease treatment guidelines. The article will also discuss pitfalls in the implementation of the IDSA antitrust settlement that should be avoided in the future. (shrink)

Many see the mithnagdim as total rationalists. Therefore it has been assumed that R. Hayyim of Volozhin’s approach to Torah study was the same. Although rationalism may be a correct characterization of the method he used in talmudic study, it does not capture how R. Hayyim understood the essence of Torah study. Some have described Nefesh ha-Hayyim as demystifying Kabbalah. I agree that R. Hayyim opposes ecstatic Kabbalah. However, already in 1972 Norman Lamm noticed that R. Hayyim saw Torah study (...) as a form of clinging to God. In my article, I go further and demonstrate how torah lishmah for R. Hayyim is a radical idea that includes a legitimate path to unio mystica, and even a way to divine inspiration. (shrink)

In Eudemian Ethics I 6, Aristotle describes the progress of the ethical investigation as a drift from a) what is true but not clarifying to b) what is true and clarifying. The drift from a) to b) is usually interpreted as the overcome of a first obscure and confused grasp of the subject by a more accurate and reliable account. In this paper, I claim that the understanding of the methodological role of a) depends upon its dissociation from the notions (...) of obscurity and confusion. What is true but not clarifying should be rather understood as a first indistinct (but not confused) grasp of the subject. Its insuficiency as regards explanation is to be accounted on the base of its indistinctness and not on its supposed obscurity. (shrink)

Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. In these dialogues Plato speaks of the soul sometimes as wholly rational, as having three parts, and so forth. But in these dialogues he is t~lklng of the human soul, which is a special (...) case, whereas in this essay I am de~Hng with the wider role and the concept of the soul as the efficient cause of motion, change, and all becoming everywhere in the cosmos. My cardinal texts in this exposition are the Sophist (246a-249d), the Phaedrus (245c, d), and a considerable portion of Laws, X. Consider the Phaedo, a dialogue with at least four motifs: it is a dramatic evocation of the last day in the life of Socrates, it is an argument for the immortality of the soul and for the reality of the world of ideas, it is a myth of the nether world, and finally, it is a theory of the cosmos as ruled by purpose--all in all, one of the great pieces of literature of the Western world. For the reader, it is an evocation of an attitude to life, based on Plato's conception of the soul--an attitude expressed in the famous phrase that the wise man spends his life meditating on death. The aims of this essay are (A) to examine the extent to which Marx, Engels and Lenin believed in revolution by peaceful means and what was their attitude towards the phenomenon of war, and (B) to reflect on the different interpretations of their writings, discerning between three schools of thought. It is argued that Marx and Engels considered violence only as an instrument of secondary importance and desirable insofar as there is no other alternative to change the system. It is (...) further contended that while they, in the course of years, adopted a more moderate position regarding the use of violence, Lenin's viewpoint radicalized as the possibility of a revolution in Russia became real. As years went by Lenin affirmed not only the use of violence but also the resort to terrorist activities. Unlike Marx and Engels he became an ardent supporter of all types of terror. (shrink)

The connective or can be treated as an inclusive disjunction or else as an exclusive disjunction. Although researchers are aware of this distinction, few have examined the conditions under which each interpretation should be anticipated. Based on linguistic-pragmatic analyses, we assume that interpretations are initially inclusive before either (a) remaining so, or (b) becoming exclusive by way of an implicature ( but not both ). We point to a class of situations that ought to predispose disjunctions to inclusive interpretations and (...) to situations that encourage exclusive interpretations. A disjunction's ultimate interpretation is based on its potential informativeness, where the interpretation of the disjunctive utterance having the smallest number of true conditions is considered most informative. Our investigation leads to five experiments employing arbitrary materials. Among the problems expected to encourage inclusive interpretations are those that present disjunctions in the antecedents of conditionals and in question forms. The best candidates to produce implicatures are those disjunctions that underdetermine an expected conjunctive conclusion, although other disjunctive utterances that are more informative as exclusive are discussed and tested. In this second edition, seven selections have been deleted and fifteen new selections have been added to greatly enhance its usefulness to beginning students in aesthetics. Additional readings on artistic creation and drama have been provided and a number of illustrations of works by Raphael, Giotto, Matisse, Dürer, Brancusi, Henry Moore, et al. have been included this time to illustrate relevant (...) textual materials. As in the first edition, the author's primary intention is to establish the field of aesthetics as having the same integrity and adventuresomeness as other areas of philosophical inquiry and debate. With this goal in view, he has organized the readings around "certain sets of basic problems that still seem worth debating and attempting to solve." Each section is centered around specific problems and issues in aesthetics, beginning with the broadest question, "What is Art?," and moving on to such issues as the nature of the various art forms, the nature of tragedy, the problem of response to art and, finally, the nature and goal of art criticism. Various readers and teachers in aesthetics no doubt, will find fault with or gaps in his selections of readings. There exists a strong need for research in clinical sport psychology which does not merely gather information on prevalence rates for psychological disorders and case studies of affected athletes. Rather, research should also uncover the underlying psychological variables which increase the risk for depression and burnout in elite athletes. Many studies gather general factors (e.g. gender, injury, sport discipline) and stay on a more descriptive level. Both constructs (burnout and depression) are based on a temporal, stress-related process model assuming the (...) development of either syndrome results from unfavorable personal (e.g. dysfunctional attitudes, perfectionism, negative coping strategies) or environmental (e.g. cohesion) factors coexisting with severe stressors (i.e. chronic stress). Integrating this knowledge, we propose a shared model for depression and burnout in athletes: a sport specific diathesis-stress model. The present longitudinal study assesses data throughout one sporting season to analyze predictors for both constructs in junior elite athletes. Hierarchical multiple linear regression analyses resulted in six predictors for best model fit. The following factors demonstrated a significant impact on predicting (a) burnout or (b) depression scores at the end of the season: dysfunctional attitudes (a and b), coping strategies (a and b), perfectionism (a), recovery (b), stress (a) and the level of depression at onset (b). Variables such as cohesion or attributional style did not significantly predict depression or burnout. The study supports the structure of a process model (diathesis-stress model) for burnout and depression with the assumption of temporal progression. With some vulnerabilities and their temporal, developmental link identified, prevention can become athlete-specific, effective and economical. (shrink)

Since the introduction of the computer in the early 1950's, the investigation of artificial intelligence has followed three chief avenues: the discovery of self-organizing systems; the building of working models of human behavior, incorporating specific psychological theories; and the building of "heuristic" machines, without bias in favor of humanoid characteristics. While this work has used philosophical logic and its results may illustrate philosophical problems, the artificial intelligence program is by now an intricate, organized specialty. This book, therefore, has a quite (...) specialized audience of its own although it can be very valuable to those philosophers who are interested and competent in using this pioneering material. Five scientific papers report attempts to solve five different kinds of problems. Bertram Raphael describes an attempt to build a memory structure that converts the information input into a systematic model by "understanding" the informational statements as they are made. Daniel Bobrow's machine can set up algebraic equations from informal verbal statements. M. Ross Quillan asks: "What sort of representational format can permit the 'meanings' of words to be stored?" Thomas Evans' machine, Analogy, serves as a model for "pattern-recognition" rather than the "common-property" method of semantic memory. Fischer Black has developed a logical deduction mechanism for question-answering which keeps track of where we are and avoids endless deduction. The editor and John McCarthy contribute more general chapters, providing the historical background of cybernetics, and dealing with the problem of formalizing a concept of causality. Minsky ends the volume with his view that our convictions on dualism, consciousness, free will, and the like are used in the attempt to explain the complicated interactions between parts of our model of ourselves.--M. About a month after his 83rd birthday Raphael Robinson was almost wholly incapacitated by a massive stroke, and 8 weeks later, on January 27, 1995, he died of ensuing complications. Mathematics was his life. He was always working on problems—those brought to him in journals or by colleagues, and others that he invented. Just three days before his death he received word that a paper of his, originating in a published problem, was accepted for publication. His 64 publications spanned (...) a full 6 decades, and included significant papers on number theory, combinatorics, complex analysis, and geometry, in addition to logic and set theory.Robinson was born on November 2, 1911, in National City, California. He came to Berkeley to study mathematics, obtaining an A.B. in 1932, an M.A. in 1933, and his Ph.D. in December, 1934. His dissertation was in complex analysis. He took 12 graduate courses in a variety of fields, but not one was close to logic or set theory—which was later the setting of about a quarter of his publications.After completing his studies Robinson served as Instructor for two years at Brown University, then returned for good to Berkeley in 1937, reaching the rank of full Professor in 1949. He taught a great variety of courses and was known as an excellent teacher, but was most interested in problemsolving and research and in 1972, at age 61, he elected early retirement, at considerable financial sacrifice, in order to concentrate on these pursuits. The article investigates the peculiarities of Durer's aesthetic views in the context of Renaissance philosophy and the theory of cognition of Modern times. Its provisions are compared with fragments of texts by L.-B. Alberti, Leonardo da Vinci, Raphael. The semantic interrelationships of Durer's positions with mysticism, pantheism, natural philosophy and empiricism of Modern Times are emphasized. The interrelation of the problem of knowledge with the theme of freedom and beauty is considered in detail. The authors analyze various opinions and (...) ways of comprehending the beautiful, presented in the philosophical constructions of Durer, his concept of "rational knowledge", "scientific ignorance". Special attention is paid to the boundaries of freedom in Durer's representation. The novelty of the research lies in the fact that the presented concept of the evolution of A. Durer's aesthetic views helps to comprehend those contradictory trends that existed in the Renaissance itself. Thus, Durer believed that freedom conditioned by knowledge ends where attempts to transcend nature begin. A necessary condition for freedom is the understanding that the beautiful is relative. From the understanding of the relativity of the beautiful, from the concrete utopian program of its achievement, an imperative grows, meaning denial, the completion of the aesthetics of Rebirth. According to him, the artist should not limit himself to one type, but should be knowledgeable in various ways of depicting all kinds of types. In order to make such an image as is required of him. Thus, the professionalism of the artist, his experience, knowledge, recognition of the power of knowledge and, at the same time, understanding of its relativity – all this, as an achievement of the Renaissance theory of art, loses its meaning. Plato does not: quite simply, Plato's ethics looks too fantastic. And Plato's ethics never looks more fantastic than in the claim that our highest good is to be like God.We find this view, in various forms, in the Phaedrus, Timaeus, Laws, Republic, and Theaetetus, as well as in the Phaedo and Philebus,1 and the ancient Platonist Alcinous in his Handbook of Platonism tells us that likeness to God () is Plato's "official" position on our final end.2 Nonetheless, this view receives very little press today: many philosophers are unaware of it; some have simply ignored it or dismissed it as an idle metaphor; and most of those who have taken it more seriously have also tended to find it too otherworldly to be of much relevance to us. This latter response is due in large measure to viewing likeness to God from the perspective of the ancient Neoplatonist Plotinus.3 But there is certainly no guarantee that Plotinus's perspective on likeness to God gives us an especially accurate reconstruction of Plato's view; indeed, the interpretation of this idea was a matter of considerable controversy among Neoplatonists, some of whom offered far less other-worldly interpretations than Plotinus's.4 [End Page 241]In any event, unraveling likeness to God in Plato requires a fresh approach that makes the greatest sense of it within Plato's larger moral philosophy. And in fact we find just such a promising understanding of likeness to God when we take a fresh look at it through Stoic lenses, and through the lens of Plato's Philebus: in both we find the idea that virtue is part of the divine realm right alongside the down-to-earth idea that virtue is rational activity in relation to the world as we find it. This is not to suppose that the Stoic conception of likeness to God is an interpretation of, or descended from, Plato's conception.5 It is simply that the Stoics also found it helpful to think of virtue as likeness to God, and it will be enough if the Stoic conception opens up the range of possibilities for understanding such an idea, allowing us to see philosophical alternatives that might take us some distance towards interpreting Plato, and that may have remained otherwise out of view. Such an understanding of the idea that virtue is likeness to God as we find in the Stoics, I argue, offers just this sort of promising and unexplored alternative in Platonism.One thing that is quite clear is that Plato means for likeness to God to offer us some insight into the nature of virtue. We see this in the Timaeus, where Plato offers a model of the three-part soul, in which mastery of the parts is justice (42 a-b) and happiness (90b-d), and is what likeness to God comes to (42b-d, 47a-c); clearly, then, the virtue in question is moral virtue. Rather curiously, Plato depicts this constitution of soul as a sort of motion which is of the same kind as the motion of the universe itself (90c-d):6 as the universe consists in orbits which are orderly and reconciled in their motion, so the human soul consists in the different orbits (44d) of reason, passion, and desire, which are out of harmony when we start life, but become more orderly as we mature (43a-44d). Born in Dallas, Oregon in 19~ 1, he was eighty-eight years old when he died. He did his undergraduate studies at Stanford, receiving his B.A. in 1925. Then he went on to graduate studies at Columbia, where he received a (...) master's degree in 1927 and a Ph.D. in 1937. He taught at City College in New York from 1927 to 1932, and then began his long career at the University of California, Berkeley, where he remained for the rest of his academic life. During World War II, he became laboratory manager of the university's Radiation Laboratory (now called the Lawrence Berkeley Laboratory), which was part of the Manhattan Project to develop the atomic bomb. After the war, Strong became a full professor in 1947, chairman of the Sociology Department from 1946 to 1952, Associate Dean of the College of Letters and Sciences from 1947 to 1955, a leader of the Academic Senate and its Educational Policy Committee, and Chancellor of the Berkeley campus from 1961 to 1965.This was a period of very rapid growth for the campus as well as its most troubled time. When the student rebellion--the Free Speech Movement--broke out, Strong tried valiantly but unsuccessfully to preserve those academic values he felt most challenged. As the conflict wore on, he ceased to have the full support of his superiors, the President of the Universityand the Board of Regents, who negotiated a resolution with the students, the effects of which are still being felt at Berkeley and elsewhere in the United States. The idea of “inner form” originates from Plotin, the founder of the so-called Neo-Platonism, and had a decisive influence on aesthetic theory from Renaissance to the 18th century. Lessing‘s assumption of “Raphael without hands” in Emilia Galotti embodies the ideal of Neoplatonist artist, who creates with his purely mental conception, untainted by the material world. Admittedly, the image of a painter who doesn‘t paint reflects the specific problematic nature of Neoplatonist conception of art. The 19th and 20th centuries saw (...) the Neoplatonist thesis that inner form precedes form on body challenged in many ways. For example, Konrad Fiedler advances the thesis that inner conception is finalised only when it is realised in some concrete matter. Nevertheless, 20th century “industrial design”, which puts conceptualisation before production, may still be described as a descendant of Neoplatonism, albeit an undesired one. Furthermore, by neglecting creation with hands as well as the material and thereby representing industrial mass products as works of art, Duchamp‘s ready made ironically testifies to the survival of Neoplatonist conception of art in the 20th century.Der Begriff der „inneren Form“ stammt vom Begründer des sogenannten Neuplatonismus, Plotin, und hatte entscheidenden Einfluss auf die ästhetische Theorie von der Renaissance bis zum 18. Jahrhundert. Lessings Annahme eines „Raphael ohne Hände“ in Emilia Galotti verkörpert das Ideal des neuplatonischen Künstlers, der mittels seiner rein geistigen Konzeption schafft, ohne durch die materielle Welt beeinträchtigt zu werden. Allerdings macht die Vorstellung eines Malers, der nicht malt, die spezifische Problematik der neuplatonischen Kunstauffassung offenbar. Im 19. und 20. Jh. wurde die neuplatonische These, dass die innere Form der Form am Körper vorausgehe, auf verschiedene Weise in frage gestellt. So vertritt z. B. Konrad Fiedler die These, dass die innere Konzeption erst dann vollendet wird, wenn sie sich in einer konkreten Materie realisiert. Jedoch lässt sich die „industrielle Formgestaltung“ im 20. Jh., die dem Konzipieren gegenüber dem Produzieren Priorität verleiht, als ein, wenn auch unerwünschter, Nachkömmling des Neuplatonismus bezeichnen. Ferner zeugt Duchamps ready made auf ironische Weise vom Überleben der neuplatonischen Kunstauffassung bis ins 20. Jahrhundert, sofern dieses sowohl das Schaffen mit den Händen als auch das Material vernachlässigt und darüber hinaus industrielle Massenprodukte als Kunstwerke zur Schau stellt.Pojam “unutrašnje forme” potječe od utemeljitelja tzv. neoplatonizma, Plotina, i imao je odlučujući utjecaj na estetičku teoriju od renesanse do 18. stoljeća. Lessingova pretpostavka “Rafaela bez ruku” u Emilia Galotti utjelovljuje ideal neoplatoničkog umjetnika, koji stvara putem čiste duhovne koncepcije, neoskvrnjen od materijalnog svijeta. Doduše, predstava slikara koji ne slika očituje specifičnu problematiku neoplatoničkog shvaćanja umjetnosti. U 19. i 20 stoljeću na različite se načine postavlja u pitanje neoplatonička teza da unutrašnja forma prethodi formi na tijelu . Tako npr. Konrad Fiedler zastupa tezu da se unutrašnja koncepcija upotpunjuje tek kad se realizira u konkretnoj materiji. Ipak, “industrijsko oblikovanje forme” u 20. st., koje poklanja prioritet koncipiranju nasuprot proizvodnji, može se opisati kao, ako i neželjeni, potomak neoplatonizma. Nadalje, Duchampovo ready made na ironičan način svjedoči o preživljavanju neoplatoničkog shvaćanja umjetnosti u 20. st., utoliko što zanemaruje stvaranje rukama jednako kao i materijal, te povrh toga postavlja industrijske masovne produkte kao umjetnička djela.
